EQUISS Terms & Conditions

These Terms and Conditions govern your use of the EQUISS website, www.equiss.org.uk (the “Website”).

By accessing or using the Website, you agree to these Terms and Conditions. If you do not agree to these Terms, please do not use the Website.

The Website is operated by EQUISS CIC, a not-for-profit Community Interest Company registered in England and Wales.

EQUISS is an independent organisation working to prevent and respond to harm, abuse and misconduct across the equestrian community.

We provide services and activities including confidential support and advocacy, information and resources, education and training, research, campaigning and work to improve safeguarding and standards across the equestrian sector.

2. Using our Website

You may use our Website for lawful purposes only.

You must not use the Website:

• in any way that breaches applicable local, national or international law or regulation;

• in any way that is unlawful, fraudulent, abusive or harmful;

• to transmit material that is defamatory, threatening, discriminatory, offensive or otherwise unlawful;

• to knowingly introduce viruses, malware or other material that could damage or disrupt the Website or another person's systems;

• to attempt to gain unauthorised access to the Website, its systems, servers or databases; or

• in any way that infringes the rights of EQUISS or another person or organisation.

We may restrict, suspend or terminate access to all or part of the Website where we reasonably believe these Terms have been breached or where this is necessary to protect EQUISS, our users or our systems.

3. Information and support provided through the Website

We aim to ensure that information published on the Website is accurate, useful and up to date. However, information is provided for general information and guidance only.

Content on the Website should not be treated as legal, medical, therapeutic or other professional advice and should not be relied upon as a substitute for advice appropriate to your individual circumstances.

Where we provide information about safeguarding, reporting, employment, welfare, criminal justice processes or other specialist matters, circumstances will vary and processes, policies and laws may change. You should seek appropriate professional advice where necessary.

Accessing information on the Website does not in itself create a casework, advocacy or other professional relationship between you and EQUISS.

4. Reporting concerns and contacting EQUISS

Our Website contains information about raising concerns and accessing support.

Submitting information to EQUISS or contacting us does not guarantee that EQUISS will be able to investigate, resolve or take action in relation to a concern.

EQUISS is independent of equestrian governing bodies, employers, the police, courts and statutory safeguarding authorities. We may provide information, support and advocacy to help people understand and navigate relevant processes, but we do not control the decisions or actions of those organisations.

Where information provided to us raises safeguarding concerns, particularly where a child or vulnerable person may be at risk of serious harm, we may need to share information with relevant authorities in accordance with our safeguarding responsibilities and Privacy Policy.

5. Intellectual property

Unless otherwise stated, the Website and its content, including text, graphics, photographs, illustrations, videos, logos, branding, downloadable materials and other resources, are owned by or licensed to EQUISS and are protected by copyright, trade mark and other intellectual property laws.

You may view, download or print reasonable extracts from the Website for your own personal, non-commercial use.

You must not reproduce, modify, distribute, republish, commercially exploit or otherwise use our content without our prior written permission, except where permitted by law or where we expressly state that a resource may be shared or reproduced.

Where material belongs to a third party, you must comply with any conditions or restrictions specified by that third party.

6. EQUISS Supporter Hub

Certain areas of the Website may only be available to registered EQUISS Supporters or other authorised users.

If you create an account, you are responsible for keeping your login information secure and for activity carried out through your account. You should notify us promptly if you believe your account has been accessed without your permission.

Access to the EQUISS Supporter Hub is provided as part of the EQUISS Supporter programme and is intended for the registered Supporter's personal use.

Supporter benefits, resources, offers and content may change from time to time. We may add, replace or withdraw individual benefits where necessary and cannot guarantee that a particular benefit or third-party offer will remain available indefinitely.

We may suspend or terminate access to the Supporter Hub where a Supporter membership ends, payment is no longer being made, these Terms are breached, or we reasonably consider suspension necessary to protect EQUISS, another user or our systems.

7. Supporter contributions and donations

You may choose to support EQUISS through regular contributions as an EQUISS Supporter or through a one-off donation.

The amount and frequency of any contribution will be clearly displayed before you make payment.

Regular Supporter contributions will continue at the agreed frequency until cancelled. You may cancel future regular payments at any time using the options provided through your account or by contacting EQUISS.

Cancellation will prevent future payments from being taken but will not normally result in the refund of contributions already made

.

One-off donations are voluntary payments to support the work of EQUISS. Donations will normally only be refunded where a payment has been made in error or in other exceptional circumstances.

Payments may be processed on our behalf by third-party payment providers. EQUISS does not directly store your full payment card details.

Nothing in these Terms affects any rights you may have under applicable consumer law.

8. Third-party benefits and offers

The EQUISS Supporter Hub and other areas of the Website may include discounts, benefits, competitions, offers, services or information provided by third-party organisations.

Unless expressly stated otherwise, these products or services are provided by the relevant third party and not by EQUISS.

Any purchase, booking, insurance policy, membership or other agreement you enter into with a third party is between you and that provider and may be subject to the provider's own terms and conditions.

We aim to work with reputable organisations but cannot guarantee the availability, quality, suitability or performance of third-party products or services.

The inclusion of a third-party offer or benefit does not mean that EQUISS accepts responsibility for the products or services supplied by that organisation.

9. Third-party websites

Our Website contains links to websites and services operated by third parties, including partner organisations, service providers and other sources of information and support.

These links are provided for information and convenience.

We do not control third-party websites and are not responsible for their content, availability, security, privacy practices or services.

A link from EQUISS does not necessarily constitute an endorsement of all content, products, services or views provided by that website or organisation.

You should review the relevant terms and privacy information before using a third-party website or service.

10. Availability of the Website

We aim to keep the Website available and functioning properly, but we cannot guarantee that it will always be available, uninterrupted, secure or free from errors.

We may suspend, withdraw, update or restrict access to all or part of the Website for operational, security, maintenance or other reasons.

We are not responsible for any interruption or inability to access the Website caused by circumstances outside our reasonable control.

11. Limitation of liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

While we take reasonable care in preparing and maintaining the Website, we do not guarantee that all information will always be complete, accurate or current.

To the extent permitted by law, EQUISS will not be responsible for loss or damage arising from:

• reliance on general information provided through the Website;

• the temporary or permanent unavailability of the Website;

• the actions, decisions or services of third-party organisations;

• third-party websites linked from the Website; or

• events outside our reasonable control.

Nothing in these Terms affects your statutory rights as a consumer.

Where you contact EQUISS for support, make a donation, become an EQUISS Supporter, create an account, subscribe to communications or otherwise provide personal information to us, your information will be handled in accordance with our Privacy Policy.

13. Linking to our Website

You may link to publicly available pages on our Website provided that you do so fairly and lawfully and do not damage our reputation or suggest an association, approval or endorsement where none exists.

You must not frame our Website within another website or reproduce substantial parts of it without our prior written permission.

We reserve the right to withdraw permission to link to our Website where we reasonably consider a link to be misleading, inappropriate or harmful.

We may update these Terms and Conditions from time to time, for example where our services change or where changes are required by law.

15. Governing law

These Terms and Conditions are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the UK or Ireland, you may also have rights under the laws applicable where you live which these Terms do not affect.

Any dispute relating to these Terms or the Website will be dealt with by the courts with jurisdiction under applicable law.
